Terms and Conditions:

Bajaj Finserv Direct Limited (“BFDL”) is merely displaying the products of various dealers/manufacturers/merchants (“Sellers”) on its website/platform, that may be purchased by a customer (“You”) by availing the credit facility (“Loan”) provided by Bajaj Finance Limited (“BFL”).

The said products are manufactured, sold and/or delivered by the Seller and the Seller shall be solely responsible for the quality/quantity/merchantability/delivery/installation/replacement/exchange in relation to the product and related services. BFDL and BFL shall not be liable in any manner whatsoever for any issues in relation to the product and related services provided by the Seller.

Terms and Conditions for Exchange Policy:

By choosing to exchange your used product (“OldProduct”) for availing the new product at a discounted price, You hereby consent and agree to the following:

  1. The Exchange Policy is valid only till the new product is available in stock with the Seller or till the expiry of the Exchange Policy for the new product, whichever is the earlier period.

  2. You hereby declare that You are the sole and absolute owner of the Old Product and all accessories in relation thereto and the same are original and genuine and free from all legal encumbrances, liens, and disputes regarding ownership or otherwise. Further, you hereby confirm and declare that the Old Product is not received from state sponsored or NGO funded distribution programs.

  3. The Old Product must be in a working condition and should not be damaged, broken or otherwise tampered with. If the Old Product is a Television, the display/screen must be intact without any scratches, cracks, discoloration, spots or any other damage of any manner.

  4. The Old Product should match the details entered by You on the product display page of BFDL’s website, at the time of placing Your order for purchase of the new product.

  5. All personal data in the Old Product must be deleted/erased before handing over the Old Product to the Seller for exchange. BFL/BFDL or the Seller shall not be responsible for the misuse of any personal data in the Old Product.

  6. You agree to indemnify and hold harmless BFL/BFDL, its affiliates, the Seller and any future purchaser (“Indemnified Parties”) of the Old Product against any and all third party claims, demand, cost, expenses be suffered, incurred, undergone by the said Indemnified Parties due to misuse of any data on the Old Product or breach of these terms and conditions.

  7. You understand that pickup of the Old Product and delivery of the new product will happen simultaneously and that you shall keep the Old Product (after deleting all personal data that may be stored in the Old Product), along with all related accessories, ready for exchange.

  8. You understand and agree that in the event You refuse to exchange the Old Product for the amount determined by the Seller upon physical inspection or in the event the Seller determines that the Old Product is not eligible for exchange, your transaction for purchase of the new product will be cancelled in its entirety.

  9. You understand and agree that once the Old Product is picked up by the Seller for exchange under the Exchange Policy, under no circumstance whatsoever will the Old Product be returned back to You. In the event Your new product is returned or cancelled for any reason, you will be paid the exchange value of your Old Product by the Seller and amounts received from You in relation the transaction, if any, will be refunded by Seller. For the avoidance of doubt, upon cancellation, any payments received in relation to purchase transaction will be refunded/returned to original source.

  10. You understand and agree that you will not bring any claim against BFDL/BFL and its affiliates for adequacy of the value of the Old Product (if any) or for any actions/inactions of the Seller.

  11. You understand and agree that the personal information provided by You under this Exchange Policy may be processed, transferred or stored by the Seller, and other entities involved in managing and administration of the exchange transaction.

  12. You understand and agree that by purchasing a product on Loan under the Exchange Policy, you will be bound by the Cancellation Terms << insert URL >>, the Replacement Policy <<insert URL>> and the terms and conditions for use of the EMI Card (https://www.bajajfinservemistore.in/product-terms-condition) and the cancellation policy of the Seller.

 

 

Frequently Asked Questions (FAQ):

For the purpose of this FAQ, ‘new product’ shall mean the new product purchased by You from the Seller on Loan through BFDL’s platform/website and ‘Old Product’ shall refer to the product that is owned by You and that is eligible for exchange.

  1. What all products are eligible for exchange?

 

The following products are eligible for exchange: LED/Air Conditioner/Refrigerator and Washing Machine.

 

  1. Under what scenarios will my Old Product qualify for exchange?

 

The Old Product must be in a working condition and should not be damaged, broken or otherwise tampered with. If the Old Product is a television, the display/screen of the Old Product must be intact without any scratches, cracks, discoloration, spots or any other damage of any manner. Please note that if the Old Product is in a non-working condition, the Seller will have the sole and absolute discretion to proceed with or cancel the purchase transaction in its entirety.

  1. Who will determine whether my product is in a working condition and/or eligible for exchange?

 

The Seller, in its sole discretion, will determine whether the product is in working condition, has suffered any damage and/or is eligible for exchange, upon physical examination of the product during delivery of the new product purchased by You.

 

  1. What happens to the transaction in the event my product is not eligible for exchange?

 

If the Seller determines that your Old Product is not eligible for exchange, your purchase transaction for the new product will be cancelled in its entirety and a refund of the amount received, if any, will be issued by Seller. For the avoidance of doubt, upon cancellation, any payments received in relation to purchase transaction will be refunded/returned to original source.

  1. How do I find out the exchange value of my Old Product?

 

The exchange value of your product can be checked by inputting the following details on the product display page (By clicking on the “Buy With Exchange” button) on BFDL’s platform:

  1. Category of the Old Product

  2. Brand of the product

  3. Whether the product is in a working condition

 

The exchange value can be seen once You click on the “Buy With Exchange” button and input requisite details.

 

 

  1. When will my product be picked up by the Seller for exchange? Can I give different addresses for pick-up of my product and delivery of the new product?

 

The Old Product will be picked when the new product is being delivered to you by the Seller. The timelines for delivery of the new product from your address is determined by the Seller and the same will be communicated to you via SMS/telephone communication from the Seller. Different addresses for pick-up and delivery of the products cannot be given and Your transaction may be cancelled in such a scenario.

 

  1. Once my old product is picked up by the Seller, can I get it back?

If the Old Product picked up by the Seller for exchange under the Exchange Policy, under no circumstances or scenarios whatsoever will the Old Product be returned back to You. In the event Your new product is returned or cancelled for any reason, you will be paid the exchange value of your Old Product by the Seller.

 

  1. Under what scenarios can my transaction be cancelled?

The transaction can be cancelled in any of the following scenarios –

  1. In the scenarios mentioned in the EMI Store Cancelation Policy <<insert link>>;

  2. In the event the Old Product is damaged;

  3. The specifications of the Old Product as provided by You do not accurately represent the actual description/state of the Old Product;

  4. Any other reason in relation to the merchantability/fitness of the Old Product, as determined by the Seller in its sole discretion;

  5. Breach by You of any of the terms and condition of the Exchange Policy.

 

  1. What happens in the event my transaction is cancelled but my product has been picked up for exchange by the Seller?

 

You will be paid the exchange value of your Old Product by the Seller and a refund of the amount received from You, if any, will be issued by Seller. For the avoidance of doubt, upon cancellation, any payments received in relation to the purchase transaction will be refunded/returned to the original source.
