Section 183 MV Act

India is a densely populated country. Here, each person wants to lead a life where they can commute from one place to another comfortably. This has led to an increase in automobile demand across the country. Almost every other person owns a vehicle. An increase in the number of vehicles on the road has also increased the road accident rate in India.

To tackle this issue sensibly, the Government of India decided to make some amendments to the Motor Vehicles Act. The only way to discipline people and help them understand the importance of following the road safety rules was to impose harsh punishments and hefty fines.

Thus, the New Motor Vehicle Act of 2019 was established. According to this new act, people who often break the traffic rules will now have to face huge penalties for the committed offence. In this article, we will be specifically discussing Section 183 of the Motor Vehicles Act.

What is Section 183 of the Motor Vehicles Act?

Section 183 MV Act is imposed for driving at an excessive speed, etc. and states that –

  1. Individuals who drive a motor vehicle above the set speed limits referred to in Section 112 are punishable under sub-Section 183(1) of the MV Act.

  2. Individuals forcing another person who is employed by them and is driving at the given moment to violate the set speed limits referred to in Section 112 is punishable under sub-Section 183(2) of the MV Act.

  3. No one would be convicted of the offence punishable under sub-Section 183(1) solely based on a piece of single evidence. The evidence needs to be represented based on the estimation obtained through any mechanical or electronic device. 

  4. At times, the published timetable or any direction given to the employed driver driving the vehicle states that any journey or a part of the journey should be completed in the specified time. However, if the journey cannot be completed within the specified time without the driver violating the speed limits referred to in Section 112, then the person held guilty will be the one given the instructions, under sub-Section 183(2) of the MV Act.

Now that you know what Section 183 of the Motor Vehicles Act states, let us take a look at the punishments under it.

Punishment under Section 183 MV Act

The individuals committing an offence under Section 183 of the Motor Vehicle Act – driving at excessive speed, etc. shall be punishable with –

  • A penalty of INR 400 for the first offence. This may increase to INR 1000 to INR 2000 for second and consecutive offences, respectively, under Section 183(1) of the MV Act.

  • A penalty of INR 300 for the first offence. This may increase to INR 500 for second and consecutive offences under Section 183(2) of the MV Act.

Also, remember to carry documents such as the vehicle registration certificate, car insurance, driving licence, and PUC with you at all times. To avoid facing any punishment, you should abide by the traffic safety rules.
