This Credit Report Terms of Use should be read in conjunction to the Privacy Policy, Site Terms of Use, Disclaimers of the Site and DPDP consent (if any) and shall collectively be referred to as “Agreement” between the User and BM.
This document (“Credit Report Terms of Use”) is published in compliance with the provisions of Information Technology Act, 2000 (as amended from time to time) and all other Applicable Laws, Guidelines, Rules & Regulations.
In this policy,
1. "Affiliates" means, in relation to any person, any entity that directly or indirectly controls, is controlled by, or is under common control with, the person, where the term ‘control’ shall have the meaning assigned to it in the Companies Act, 2013, as amended from time to time.
2. "Applicable Laws" includes any applicable constitution, statute, law, rule, regulation, ordinance, decree, order, judgement, authorization, or any directive, guideline, requirement or government restriction or Digital Personal Data Protection Act (“DPDPA”) having the force of law, or any determination by, or interpretation of any of the foregoing by, any judicial authority, whether in effect as of the date of the Agreement or thereafter and each as amended from time to time within the jurisdiction of India.
3. “Bureau” shall mean credit information company etc., which is authorized under Applicable Laws of India to provide comprehensive credit information by collecting, collating, and issuing credit information, pertaining to both commercial and consumer borrowers, to a closed User group of members. In relation to provision of the Services mentioned herein.
4. “Credit Report Terms of Use” shall mean the terms of use, pertaining to the credit information company and relevant terms of the Site, for enjoying the Services of availing the credit report as offered on the Site. Such Credit Report Terms of Use shall always be read with Site Terms of Use, Privacy Policy Disclaimers of the Site and DPDP consent (if any).
5. “Partner” means banks, nonbanking financial institutions, housing finance companies, insurance companies, fintech companies, broking, Bureau and such other financial institutions which are regulated by RBI, SEBI, IRDA either directly or indirectly etc. with which BM has an arrangement to offer their products on the Site.
6. “Site” means any web site, mobile site, or application, owned, and operated by us.
7. “Service” means using our products, software, services, as available on our Site and any products offered by our Partner’s on our Site.
8. “Service Provider” means any authorized Service Provider engaged by BM thereby enabling us to offer Services on Site.
9. “Third Parties” shall mean and include Service Provider(s) and Partner(s).
10. “We,” “us,” and “our” means Bajaj Markets (“BM”);
11. "I", “You”, “you”, “your” and “User” mean anyone who visits, accesses, or uses our Site or obtains Services from us through our Site.
The Services rendered by BM are exclusively intended for individuals who are citizens of India and residing in India and are above 18 years of age. By accessing our Site and/or using the information provided on or via this Site, you agree that you have gone through the Site Terms of Use, Privacy Policy and you agree to the terms of use as stated under the following. If you do not agree with the terms of use stated hereunder, you shall not access, visit and/or use the Site and avail our Service.
By using this Site, you confirm that you are a resident of India and have attained the age of at least 18 years, and you are legally entitled to enter into a binding contract and that you are not a person barred from receiving Services under the Applicable Laws of India and will only use the Site to make legitimate transactions for you or for another person for whom you are legally authorized to act (and will inform such other persons about the Site Terms of Use, Credit Report Terms of Use, Privacy Policy, Disclaimers and DPDP consent (if any)) that apply to the interactions you have made on their behalf (including all rules and restrictions applicable thereto). You also confirm that the statements, answers and/ or information given by you are true and complete in all respects and that you are authorized to avail the Services on behalf of other person(s).
You agree that you have appointed BM as your lawful agent for the purposes including but not limiting to receive your credit information from Bureau and to keep record of day-to-day changes in your credit information for the purpose of getting alerts on your behalf at intervals in order to deliver your credit report to you. The format of such consent from Bureau is covered in the following paragraphs.
You are aware that BM will get these updates from Bureau(s) and may notify you at intervals. You realise that it is important to stay aware of changes to your credit actions and transactions that may impact your credit score and access to various credit products. You explicitly authorise BM as an appointed agent to monitor all changes in your credit information and consequently, notify you of such changes and send offers related to credit products and recommendations to you, to take necessary actions and reduce the possibility of exposing you and to prevent you from adverse impact on your credit score. You understand that credit report is based on changes in your credit score, and you may receive incorrect credit report, hence, BM shall not be responsible in any manner for the same. In view of the above terms, you provide your explicit consent on the following:
1. That you may receive communication on credit report from BM or through its authorized Service Providers, via pop-up notifications, SMS, WhatsApp, email, on the BM digital platform.
2. That in the event of any update on or change in my credit information and/or credit score, BM may send communication/update on my registered Mobile Number/Email.
By accepting these terms and conditions; you are providing “written instruction” to BM to obtain your credit information from Bureau(s). You further authorize BM to share your personal identifiable information with the Bureau(s), to confirm your identity and to obtain the credit information on your behalf.
You undertake that the information provided by you is true and accurate and shall match with the details provided by you to the banks and other credit institutions with whom you have relationship(s). You understand that you shall have access to the credit report upon login using your registered User ID/mobile number on BM’s Site. You also understand that you may have to further authenticate yourself as per the Bureau authentication process. You understand that BM shall have all the rights to reject your request form due to any reason and shall not be required to specify such reasons for rejection. You understand that due to incomplete or incorrect information provided by you; You may receive incorrect credit report; BM shall not be responsible in any manner for the same.
You understand that BM obtains the information from Bureau and is reported to you on “as is” basis and shall not be required to verify the correctness of information received. Therefore, you shall not hold BM accountable for the accuracy, completeness or fitness for a particular purpose, or non-infringement of any and all such information as provided in the report to you. The analysis or recommendation provided as part of the Services is based on certain assumptions applied by BM on the information obtained from you and/or the data as available with BM.
You realize the information contained in the credit report is for illustrative and information purposes only and does not constitute as professional advice or solicitation and BM thereby holds no liability. You understand that BM may enrich the information in the credit report based on your past credit information held with BM to make more personalized recommendations to you. The report may contain certain proprietary information of BM and is meant only for use for the receiver of the report and you undertake not to circulate the report to any other person/entity. you shall not hold BM liable or responsible whether financial or otherwise, for the losses or damages caused directly or indirectly, for any action taken by you placing reliance on this report. You shall have sole responsibility of your actions and decisions. You acknowledge that BM shall have no liability or require to indemnify you for loses, claims, expenses, damage incurred by you for any incorrect report provided due to any technical error, incorrect information provided by you or otherwise.
A. Payment Terms:
1. You agree to make the payment for availing the credit report, as stipulated by BM from time to time, (as applicable). You understand that there may be additional charges apart from subscription charges which may be applicable for payment of subscription charges. Subscription charges along with additional charges shall collectively be referred to as “payment/s”. Such payment amount shall be displayed on the transaction screen prior to the payment being initiated.
For the purpose of this Credit Report Terms of Use:
(“additional charges” means bank charges, MDR charges payment gateway charges (plus applicable GST)). Additional charges are the charge imposed and paid to your bank/Issuer
(“subscription charges” means charges for the credit report inclusive of GST). Subscription charges are the only charges that are paid to BM.
2. You agree and understand that unless the full and final payment is not made by you along with the required information, Bureau will not be able to generate the credit report.
3. You undertake that the payment instrument used by you belongs to you or you are fully authorized to make use of such instruments to make payments. You understand the payment gateways services for such payment does not belong to BM. You shall not hold BM responsible for the error that might occur due to/on such payment gateway and BM shall not be obligated to indemnify you for any loss, damage, claim suffered by you due to use of such payment instruments and/or payment gateways. You understand that once the credit report is generated upon the full and final payment, same shall be ready to download for a limited period of 30 days.
B. Payment Modes:
1. Payment through Credit Cards/Debit Cards (as and when activated):
You understand that payment for availing the credit report generated by Bureau, may be made by using a VISA or MASTERCARD or RUPAY or other payment gateways Credit Card or Debit Card as the case may be.
2. Payment through Net Banking/mobile banking (as and when activated):
You understand that payment for credit report may be made through your net banking channel/mobile banking.
3. Payment through UPI (as and when activated)
You understand that payment for credit report may be made through your UPI channel.
C. Refunds
1. Any payment made by you for accessing, downloading, or viewing your credit report through the Site is non‑cancellable and non‑refundable once the transaction has been successfully processed.
2. Refunds shall be considered only in the following limited circumstances:
a. where the payment has been successfully debited from your account but the credit report has not been delivered or made accessible to you due to a technical failure solely attributable to BM;
b. where the transaction is duplicated due to a technical error, resulting in multiple debits for the same credit report.
3. No refund, shall be applicable in cases where:
a. cancellation made by you is post successful payment;
b. the credit report has been successfully generated, accessed, viewed, or downloaded by you;
c. non‑delivery or inaccessibility of the credit report is caused due to incorrect or incomplete information provided by you, or due to issues attributable to third‑party credit information companies, banks, financial institutions, or service providers beyond BM’s reasonable control; or
4. In the event a transaction remains pending or fails, you may contact BM’s customer support for assistance. BM shall use reasonable efforts to assist you in resolving such issues in accordance with applicable laws and internal processes. Any approved refund, if applicable, shall be processed only to the original source of payment, within timelines prescribed under applicable law and regulatory guidelines.
D. Chargeback
1. You may raise a dispute or initiate a chargeback with your issuing bank or payment gateways in accordance with applicable rules as agreed between you and your service provider, including but not limited to circumstances such as unauthorized or fraudulent use of my card or bank account;
2. You acknowledge that initiation of a chargeback does not automatically entitle you to a refund. All chargebacks shall be subject to verification, investigation, and applicable banking, card network, and regulatory rules.
3. A chargeback may be rejected, including but not limited to situations where:
a. BM has successfully provided the credit report in accordance with these terms;
b. the transaction was authorized by you and completed successfully;
c. the dispute is raised after the credit report have been accessed or utilized;
1. You agree that the terms and conditions may be amended from time to time without any notice; which changes shall be available on the Site. You understand that BM may at its sole discretion may amend, discontinue the credit report subscription services in part or whole as it deems fit at any time without a requirement of prior notice or consent.
2. You understand that BM reserves all the rights to suspend, terminate, your account at its sole discretion at any time for any reason but not limiting to breach of the terms of use by you, if the information provided by you is incorrect, obtained or is intended to be used for fraudulent purposes.
3. Any disputes relating to the credit information can be raised with respective Bureau on their website and BM has no role to play in terms of rectifying the errors, omissions etc.
4. You understand that BM is only acting as a facilitator for providing a platform for you to access your credit status in the form of credit report and BM does not warrant that the functions contained in on the Site will be uninterrupted or error free, free of viruses or other harmful components, but shall take commercially reasonable efforts to correct the delays in operation of the Site.
5. You agree to abide by the terms of TUCL as under: -

Sub: Grant of Consent
Dear Sirs,
In connection with submission of the application for my credit information (“Credit Information Report”) offered by TransUnion CIBIL Limited (TUCL) through Bajaj Finserv Direct Limited and delivery of the Credit Information Report to the Company, I hereby acknowledge and agree to the following:
A. The Company is my lawfully appointed agent and it has agreed to be my agent to receive the Credit Information Report from TUCL on my behalf and use Credit Information Report for the purpose of sharing it with me, for ongoing credit monitoring and to provide me with customized recommendations and personalized offers of the products and services of Company and/or its business partners and/or affiliates at the sole discretion of Company (“Purpose”) and the Company has granted its consent for being appointed for the aforesaid Purpose.
B. I grant my unconditional consent to the Company to receive the Credit Information Report from TUCL on my behalf and the Company has granted its consent for being appointed for the aforesaid Purpose.
C. I hereby expressly grant unconditional consent to, and direct, TUCL to deliver my Credit Information Report to the Company on my behalf. I further expressly consent to TUCL storing and using my logs relating to the access of my credit information and sharing such information with third parties for the purpose of assessing my credit awareness / monitoring behaviour or other purpose permitted under applicable law.
D. I agree that my consent shall be stored by the Company either as an electronic or physical record and which is permanent in nature and shall be verifiable from time to time. I understand that the Company can receive the Credit Information Report only on the basis of my consent. I understand that based on my present consent the Company can refresh and access my Credit Information Report multiple times for a period of 6 months from the date of this present Consent given to the Company. Company can store the Credit Information Report only for (i) a limited time period of six months or (ii) till such time the credit information is required to be retained to satisfy the abovesaid Purpose for which it was provided or (iii) until I withdraw my consent to store such Credit Information Report, whichever is earlier and thereafter, the stored Credit Information Report shall be deleted, purged, expunged by the Company.
E. I shall not hold TUCL responsible or liable for any loss, claim, liability, or damage of any kind resulting from, arising out of, or in any way related to: (a) delivery of my Credit Information Report to the Company ; (b) any use, modification or disclosure by the Company of the contents, in whole or in part, of my Credit Information Report, whether authorized or not; (c) any breach of confidentiality or privacy in relation to delivery of my Credit Information Report to the Company.
F. I acknowledge and accept that TUCL has not made any promises or representations to me in order to induce me to provide my Credit Information Report or seek any consent or authorization in this regard.
G. I agree that I may be required to record my consent / provide consent electronically and in all such cases I understand that by clicking on the "I Accept" button below, I am providing "written consent " to COMPANY authorizing COMPANY to obtain my Credit Information Report from my personal credit profile from TransUnion CIBIL LIMITED]. I further authorize COMPANY to obtain such information solely to confirm my identity and display my Credit Information Report to me. Further in all such cases “By checking this box and/or clicking on the ‘Authorize button, I agree to the terms and conditions, acknowledge receipt of TUCL privacy policy and agree to its terms, and confirm my authorization for [COMPANY] to obtain my Credit Information Report.
H. I understand that in order to deliver the product to me, I hereby authorize COMPANY, to obtain my Credit Information Report from TUCL.
I. I UNDERSTAND THAT THE PRODUCT IS PROVIDED ON AN “AS-IS”, “AS AVAILABLE” BASIS AND TUCL EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
J. I shall not sue or otherwise make or present any demand or claim, and I irrevocably, unconditionally and entirely release, waive and forever discharge TUCL , its officers, directors, employees, agents, licensees, affiliates, successors and assigns, jointly and individually (hereinafter “Releasee”), from any and all manner of liabilities, claims, demands, losses, claims, suits, costs and expenses (including court costs and reasonable attorney fees) (“Losses”), whatsoever, in law or equity, whether known or unknown, which I ever had, now have, or in the future may have against the Releasee with respect to the submission of my Credit Information Report and / or my decision to provide TUCL with the authority to deliver my Credit Information Report to the Company. I agree to defend, indemnify, and hold harmless the Releasee from and against any and all Losses resulting from claims made against TUCL by third parties arising from and in connection with this letter.
K. I agree that the terms of this consent/confirmation letter shall be governed by the laws of India and shall be subject to the exclusive jurisdiction of the courts located in Mumbai in regard to any dispute arising hereof. TUCL is entitled to assign its rights hereunder to any third person without taking my prior written consent.
