TERMS AND CONDITIONS OF QUIZ PARTICIPATION
By Participating in this Quiz (defined below), “You” hereby agree to be bound by:
- Specified terms and conditions in the Offer notification.
- Terms of Use, Privacy policy of the Site (“Site” has the same meaning as defined in the Terms of Use including but not limiting to BM Website and Mobile Application)
And any other modifications, alterations and updates thereof, which are published on the Website
1. DEFINITIONS:
Following words shall for the purpose of these terms and conditions, be defined to mean as below:
“BM” refers to Bajaj Markets.
“Participant of the Quiz” or “You” or “User” refers to an Indian citizen, residing in India, having a valid proof of residence for the same and is participating in the Quiz.
“Bajaj Markets App” or “App” refers to the Mobile application of BM available on Google Play Store & App Store under the same name.
“Offer Period” shall differ for each Offer. Please refer to the Offer notification for details.
“Offer” shall mean the “Quiz” that is going held on the Bajaj Markets App by BM for the Participant of Quiz during the Offer Period.
“Reward” shall be the prize value which winner of the Quiz shall receive which shall be published in the communication related to the Quiz, and which may differ per category from time to time on sole discretion of BM.
“Winner” shall be one of the Participant who is selected through a random draw and fulfils the terms and conditions defined herein or mentioned in notification of Quiz or any other criteria which may be specified by BM from time to time
2. MINIMUM ELIGIBILITY FOR PARTICIPATING IN THE QUIZ
You may participate in this Quiz subject to fulfilment of the following criteria:
1. Be a citizen of India and can provide valid address and identity proof for the same if so, required by BM.
2. Be of 18 years of age or above and below 100 years of age and can provide valid documents like PAN Card as proof of age if so, required by BM.
3. Quiz shall be hosted on Bajaj Markets App and the participant should have registered/registers on the Bajaj Markets App to be eligible to participate in the Quiz.
4. Specified terms and conditions in the Offer notification of Quiz.
3. EXCLUSIONS FOR PARTICIPATING IN THE QUIZ
1. Non-residents of India are not eligible for participation in the quiz even if they participate by accessing to the Platforms from an Indian IP address.
2. If the details provided [viz. the phone number/contact details] are incorrect or does not belong to you.
3. Using any kind of foul language to fill out contact details or on social media where the quiz will be promoted.
4. Employees of BM are not eligible to participate.
5. Winner is any one category shall not be eligible and considered for Rewards of other category during the Offer Period.
6. The Offer is not available for residents of Tamil Nadu.
7. Any other prohibitions by Law applies.
4. ANNOUNCEMENT OF REWARD
1. Winners will be announced on BM’s social media pages and any other medium which BM may decide on from time to time.
2. Winner shall be contacted via SMS and/or Email and/or phone call within 10 days from expiry of the Offer period. However, if the contact details provided are found to be wrong or if Winner fails to be contactable at the details in BM records; within 24 (twenty-four) hours from the time of 1st contact attempt made by BM, BM will no longer make any further attempts to contact the said Winner. In the event, successful contact with the Winner is not established that Winner shall not be considered for the Prize and BM may choose another Winner at its sole discretion.
3. The Prize shall be awarded to the Winners pursuant to verification of the records and in accordance with Specified terms and conditions in the Offer notification; BM holds all right to withdraw/cancel the reward if the erroneous details are provided or any failure in providing the details.
5. DISCLAIMERS AND GENERAL TERMS:
1. Please note that there may be other Offers of similar nature or ongoing promotions during this Offer Period. By Participating in this Offer you shall not be eligible to receive any Rewards of the other Offers.
2. BM reserves the right to update the terms and conditions at any time without a notice to the Participant of Quiz. BM is not making any commitment to conduct any such similar Quiz/s beyond the Offer Period.
3. BM shall have the sole discretion to determine who qualifies as a Winner as per the eligibility for the Quiz. BM’s decision in this regard shall be final and binding.
4. User can play the quiz only once.
5. Lucky winners will be picked based on random selection.
6. The Reward received under the Quiz is non-transferable and non-negotiable. Under no circumstance will the reward received under the Quiz be settled in cash.
7. BM shall not be liable for any cost or expense over and above the Reward.
8. You may not be able to participate in the Quiz if BM Site is down.
9. The participation in the Quiz is purely voluntary. Mere participation in the Quiz does not entitle the participants to win a Reward.
10. There may be imposters, fraudulent website which may host similar offer claiming to be of BM; You are required to exercise Your prudent judgement before providing your personal information on such sites. BM disclaims all liabilities, damages, loss caused to You due to lapse of judgement on Your part.
11. The rewards under this Quiz are given by BM and issuance of the rewards under this Quiz does not amount to endorsement of products, services provided by the any third-party provider of such Rewards. (“Service Provider”).
12. BM shall not be liable for any missed services, quality, defect or deficiency in the Products /Services offered as Reward under this Quiz.
13. BM reserves the right at any time to change, modify, withdraw, extend or terminate this Quiz at its discretion, without any prior notice and without any liability or obligation in this regard.
14. By participating in this quiz, providing us with your contact details and/or following us on social media pages, you expressly authorize BM to call back, send you text messages, messages through chatbots or advertisements on social media for solicitation or procurement of various products and services offered by BM through Bajaj Markets App.
15. BM reserves the right to clawback any Reward which has been erroneously credited against the terms and conditions of this Offer.
16. The Quiz shall be subject to all applicable laws, rules and regulations in India and would be modified/discontinued based on any amendment, modification in such laws, rules and regulations from time to time. In the event, the Quiz cannot be continued with total compliance due to such amendment, modification to applicable laws, rules and regulations, the Quiz shall be deemed to be terminated forthwith from the date when the amended law restricting / prohibiting the Quiz comes into force.
17. All the terms and conditions hereunder shall be governed by the Laws in India. Any disputes arising out of and in connection with this Quiz or otherwise shall be subject to the exclusive jurisdiction of the courts in Pune only. Existence of dispute does not constitute a claim against BM.
18. Nothing expressed or implied in the Quiz or Terms and conditions of Quiz participation shall in any way waive or amend any of the applicable terms and conditions on our Platform.
19. BM, its group entities/affiliates or their respective directors, officers, employees, agents, vendors, etc., shall not be liable for any loss or damage whatsoever that may be suffered, or for any personal injury that may be suffered by a participant of the Quiz, directly or indirectly, including for reasons arising out of use or non-use of the Reward/s or participation under this Quiz.
20. Images of the Reward shown on email, Website or any other advertisement material whatsoever, are for representational purpose only. Notwithstanding anything contained herein, all intellectual property rights pertaining thereto which belong to any third party, shall continue to vest with such party and by using such images, representations etc., BM in no way claims any right whatsoever relating to such intellectual property.
21. The Quiz and the Rewards thereunder shall be subject to usual force majeure events and on occurrence of such force majeure event, the Offer may be withdrawn at the discretion of BM.
22. Any Reward from Quiz exceeding ₹10,000 in a year, is liable for TDS u/s 194B of Income Tax Act, 1961 @ 30% and copy of Pan Card shall be required to be provided at the time of confirmation of award. Any failure in providing the details/PAN Card as required hereunder shall disqualify the User in winning the Rewards hereunder.
23. This document is an electronic record in terms of Information Technology Act, 2000, and the Rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.
