TERMS & CONDITIONS: DIGITAL GOLD VOUCHER WORTH UPTO ₹1000 FOR AVAILING GOLD WORTH ₹10000 & more
1. DEFINITIONS:
Following words shall for the purpose of these terms and conditions, be defined to mean as below:
a. “BFDL” refers to Bajaj Finserv Direct Limited.
b. “Customer” means an Indian citizen who avails Digital gold from “SAFEGOLD” through BFDL’s Website during the Offer Period and fulfilment of other eligibility criteria.
c. “Digital Gold” means minimum 99.5% pure 24 karat gold offered to the retail customers under DGIPL’ s brand “SafeGold” digitally through BFDL’s website.
d. “Safegold” hereby means the partner/Seller viz. Digital Gold India Private Limited who is offering services of purchase and sale of Gold to retail customers through the BFDL’s Website.
e. “Offer Period” shall mean the period commencing from April 5th, 2020 00:00 to April 30th, 2020 23:59.
f. “Promotion” shall mean the “Digital Gold Voucher worth up to ₹1000” (“Reward”) promotional program offered by Safegold for the Customers during the Offer Period.
g. “Reward” refers to reward offered to the eligible Customers(s) under the Promotion.
h. “Website” means BFDL’s website at the following URL www.bajajfinservmarkets.in and shall include Mobile app as well.
2. By Participating in this Offer (defined below), “You” or “Customer” agrees to be bound by:
a. General Terms and Conditions of the Offer
b. Terms of Use, Privacy policy of the Site (“Site” has the same meaning as defined in the Terms of Use including but not limiting to BFDL Website and Mobile Application)
c. Terms and Conditions of Products and Services offered on BFDL Site including Digital Gold.
d. And any other modifications, alterations and updates thereof, which are published on the Website.
3. To participate in this Promotion and to be eligible to receive the Rewards thereunder, Customer should have mandatorily performed all of the following:
i) Buy Digital Gold worth ₹10,000 and more from “SAFEGOLD” on BFDL’s Website during the Offer Period wherein if the Digital Gold is purchased through various transaction.
ii) The Digital gold purchased during the said Offer Period is not sold till 30th May 2020.
iii) Offer eligible for first 1000 Customer only on FIFO [First cum first offered] basis only.
iv) This Offer is applicable only for the Users who have availed Digital Gold directly from BFDL’s Website; any Referral and or re-directed customers from other Platforms are not eligible for this Offer.
v) Additionally, all Users who buy Gold worth ₹5,000-₹9,999 during the Offer Period and qualify to all the other Offer terms and conditions shall receive free subscription of Markets Plus worth ₹ 599 by BFDL.
4. This Promotion is not applicable for Customers from Tamil Nadu. Any other prohibitions by Law applies.
5. A Customer can qualify only once for the Promotion during such Offer Period. For the avoidance of doubt, it is hereby clarified that a Customer shall be eligible for only one Reward under this Offer during the Offer Period.
6. Digital Gold Voucher shall be sent via SMS to the eligible Customers registered mobile number, post 31st May 2020 by the Seller. The Digital Gold vouchers shall be valid for 15 days from the date of issue.
7. Redemption of the Digital Gold Voucher:
a. The Voucher code as received by the eligible customer hereunder, should be applied under Redeem Voucher section of Digital Gold page on Bajaj Markets, the Gold back of ₹1000 hereunder shall be credited to the customer’s Digital Gold Locker.
b. The Voucher has to be redeemed in full. Partial redemption is not allowed.
c. This Voucher is not redeemable for cash or credit nor can be exchanged for a gift card/gift card.
d. If the Customer misplaces/deletes the SMS with the voucher/voucher code, BFDL shall not be responsible to reimburse/refund.
e. Validity period of this voucher will not be extended under any circumstances.
8. Details of Market Plus Subscription reward and its redemptions process shall be shared in a separate document on email or SMS.
9. The Customer acknowledges and accepts that the Buy Price of Digital Gold may be different from the Sell Price of Digital Gold and BFDL is not liable for any price difference and price movements in the Digital Gold.
10. Any taxes, duties, levies or liabilities or charges payable (except ‘Gift’ tax or Tax Deducted at Source ‘TDS’) to the Government or any other authority or body, if any, shall be borne directly by Customer and BFDL will not be liable in any manner whatsoever for any such taxes, duties, levies or other statutory dues.
11. This Promotion is a special offer for BFDL Customers available during Offer Period only and nothing contained herein shall prejudice or affect Customer terms and conditions for availing Digital Gold from Safegold through BFDL’s Website. These terms and conditions shall be in addition to and not in derogation to the Customer terms and conditions for availing Digital Gold from Safegold through BFDL’s Website.
12. Participating in this Promotion is voluntary, and the Customer is not bound to participate in this Promotion. Also, there is no compensation for non-participation in the Promotion under any circumstances whatsoever.
13. The Offer shall not be available if the Website of BFDL is down.
14. You may also have to upgrade the Bajaj Markets app to access and participate in the Offer.
15. The Offer/Rewards are non-transferable and non-negotiable. Under no circumstance will the Offer be settled in cash.
16. Where the Customer has provided any incorrect information at the time of registration for the Promotion and/or at the time of collecting his/her Reward, then his/her selection is subject to cancellation at the sole discretion of BFDL.
17. BFDL and Seller will have the sole discretion to determine who qualifies as an eligible Customer, as per the eligibility criteria, and BFDL and Seller’s decision in this regard shall be final and binding on the participating Customers.
18. Images of the Reward shown on email, Website or any other advertisement material whatsoever, are for representational purpose only. Notwithstanding anything contained in the Promotion or these terms and conditions, any images, representations etc. and all intellectual property rights pertaining thereto which belong to any third party, shall continue to vest with such party and by using such images, representations etc., BFDL/Seller in no way claims any right whatsoever relating to such intellectual property.
19. Nothing herein amounts as a commitment by BFDL to provide further or similar schemes or offers after the Offer Period.
20. This Promotion cannot be clubbed with any other offer offered by BFDL for its Customers.
21. BFDL shall not be responsible for the quality, authenticity, genuinity, merchantability or the fitness for any purpose or any other aspect related to the Digital Gold provided as it is providing Digital gold as Facilitator on AS IS basis.
22. Seller reserves the right to update the terms and conditions at any time without a notice to the Customer.
23. BFDL, its group entities/ affiliates or their respective directors, officers, employees, agents, vendors, etc., shall not be liable for any loss or damage whatsoever that may be suffered, or for any personal injury that may be suffered by a Customer, directly or indirectly, including for reasons arising out of use or non-use of the Rewards or participation under this Promotion and or for any failure of the Seller to provide Offer benefits/ Prizes to the eligible Customer. BFDL shall not be liable for any failure of the Seller to provide Offer benefits/ Prizes to the eligible Customer. Seller shall indemnify and hold BFDL harmless against any claims by the Customer in this regard.
24. BFDL shall not be liable for termination or delay of the Promotion or the Rewards forming part of the Promotion due to any force majeure event and will not be liable for any consequences.
25. The Customers agree to be bound by the terms and conditions contained herein. Without a Customer being required to do any further act, the Customers shall be deemed to have read, understood and unconditionally accepted the terms and conditions herein.
26. BFDL reserves the right at any time to change, modify, withdraw, extend or terminate this Offer at its discretion, without any prior notice and without any liability or obligation in this regard. These terms and conditions prevail over the contents of any brochure or other promotional material advertising the Promotion.
27. The Offer shall be governed by the Laws in India. Any disputes arising out of and in connection with this Offer or otherwise shall be subject to the exclusive jurisdiction of the courts in Pune only.
28. Disputes regarding the Seller Offer, if any, regarding the Rewards under the Offer can be submitted in writing by the customer to contact@bajajfinservmarkets.in. BFDL will forward the complaint to the Seller for amicable resolution. In no scenario will BFDL take any liability of product and services offered by the Seller. The resolution of dispute will solely be responsibility of the Seller.
29. This document is an electronic record in terms of Information Technology Act, 2000, and the Rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.
