WBHIRA - RERA West Bengal Latest News Updates

June 2023: The Bengal Government recently announced slashing the size of residential development to come under RERA. This step has been taken with the aim of bringing the pool of small-sized projects within the umbrella of the buyer-friendly law. The state housing department stated that the projects that come up on one plot, do not exceed 200 square metres of area and six apartments would be exempted from getting  Real Estate (Regulation & Development) Act, 2016 registration.

The changes would come into effect immediately. Thus, the projects that have been taken up by the unorganised sector and are often found to be lagging in construction quality would now come under this Act.

Ease of Home Loans

Purchasing a home has become easier for individuals and families everywhere, especially with increased financing options. At Bajaj Markets, one can get a range of choices which enable potential homeowners to avail Home Loan of up to Rs. 5 Crores and even get an additional Home Loan top up. With easy-to-fulfill eligibility criteria and increased convenience, which enables the loan process to be completed online, it is now significantly easier for homeowners to buy property.

While the Centre passed the RERA Act, all the states were asked to create their own legislation in line with the Central Act. In West Bengal, RERA took the shape of West Bengal Housing Industry Regulation Act (WBHIRA). WBHIRA makes the buying and selling of property an extremely transparent process, and offers homeowners protection. The HIRA West Bengal Act has also made provisions for quick and efficient resolution of disputes which may arise between property developers and homeowners. Read on below to learn the requirements from promoters or developers in terms of following the guidelines for RERA West Bengal.

Documents Required

For promoters or developers or any other entity interested in selling a property, they are required to submit a few documents and list their property on the WBHIRA website. For RERA West Bengal registration, the WBHIRA is the appropriate platform.

A promoter of a real estate project can register his property on WBHIRA by registering the following documents:

  • Details of the company’s financial health and identity, through the copy of the PAN Card.

  • A balance sheet which has been audited, for the previous financial year, as well as ITR for the three financial years preceding the current year.

  • The total number of parking areas, including open parking areas, available on the property.

  • The promoter must also submit a copy of the legal title deed, which demonstrates that the property is rightfully theirs.

  • Details of the land and any encumbrances on it.

  • The promoter must submit a declaration to the effect that no discrimination shall happen against any potential homebuyer at the time of allotment of the property.

  • Other major details of the concerned project, including its total area, including built up area, and even the current status of development or construction.

The documents required from real estate agents who wish to apply for the RERA West Bengal registration differ only slightly from the documents required from real estate promoters. The real estate agent who wishes to register under the West Bengal RERA equivalent authority must submit the following documents:

  • A copy of the PAN Card

  • Details of the enterprise they are associated with, including name, type of enterprise, and its legally registered address.

  • Any other particulars of registration, including the relevant by-laws as well as the memorandum of association.

  • Photographs of the individual in case of independent real estate agents, or photographs of all the concerned partners, directors, etc.

  • Proof of ITR from over the last three years.

  • Legal documents related to the land, its purchase, deeds, etc.

  • Copy of the company or other entity’s proof of address.

WBHIRA or West Bengal RERA has also declared a range of charges, which differ based on the particulars. For instance, the registration fees for different kinds of entities are different and the charges for different kinds of properties vary as well.
