Land Record Registration Process

The service of registering a property online is available in all 29 Indian states. It is important to note, however, that only a portion of the registration procedure can be completed online. The following are the stages involved in the online registration of a land in India:

  • Step 1: Calculate the circle rate for the area where your property is located. Depending on the type of property, the circle rate may differ.

  • Step 2: Determine the property's registration fees and stamp duty.

  • Step 3: Make an online payment for the property's registration fees and stamp duty.

  • Step 4: Schedule an appointment with the sub-office registrar's in the county where the property is located.

  • Step 5: The buyer, seller, and two witnesses must all sign the property documents before they can be submitted for registration.

  • Step 6: On the scheduled appointment date, go to the sub-office registrar's and present the property documents for final registration.

Note: To complete the online registration process, you must have an active mobile phone number. This is important because you will be required to use the OTPs supplied to your phone number to identify and validate your login and submissions.

Documents Required for Land Registration Process

The online and offline registration processes are the two main aspects of the land registration procedure. You will not be needed to upload any papers during the online registration procedure. You will, however, be needed to obtain e-stamp sheets and pay the registration cost and stamp tax online. In addition, you will be needed to give the following information:

  • The locality, pin code, and other details about the property are described.

  • Industrial, residential, commercial, and other types of properties are available.

  • The type of land ownership – purchase, lease, gift, and so forth.

How to Change the Owner's Name in Land Records Online

To modify or amend the land owner's name in the land records, follow these steps:

  • Step 1: Make an affidavit - By filing an affidavit signed by a notary and two gazetted officers, you can update the land owner's name in the land records. The current land owner's name, the new land owner's name, and the reason for the name change should all be included in the affidavit.

  • Step 2: Publication of an ad in a print publication - Following the change of name in the land records, an announcement shall be published in two newspapers, one in English and the other in the state's official regional language. The prior owner's name, the new owner's name, the date of birth, and the address should all be included in the advertisement.

  • Step 3: Publication of a notice in the Gazette - To complete the change of owner's name in the land records, a copy of the aforementioned advertising should be delivered to the Department of Publication, along with all supporting documentation.

  • Step 4: Visit to the land registry - After the land owner's name has been officially changed, the present land owner should go to the land registry office with all of the necessary documentation linked to the name change. These should be submitted with a little charge attached. The name will be amended in all land records after this is completed.

  • Step 5: Verification - The documents will be reviewed by the competent officials once they have been submitted to the land registry office to ensure that the change of land owner's name is authentic.

  • Step 6: Name change - The name of the new landowner will be updated in all official records once the above-mentioned verification is finished. A copy of this will also be sent to the applicant's registered address. In some states, this procedure can also be completed online through the land records' online portal. The time it takes to update the name in the land records is around 20 days.

Correction of Land Records Spelling Errors

It's crucial that the name in the land records is spelled correctly. Any spelling errors will cause problems whether applying for a housing loan, a mortgage, or selling the property. Whether it's a misspelling or an omission of the middle name, they should be corrected as soon as possible once they've been detected. It is necessary to amend the land records with the correct spelling of the name, as well as any names that are missing.

A notarized affidavit must be presented to the land registry department in order to do this. The affidavit should state that there was an overlook that led to the error, as well as the error and how it was corrected. After the verification is finished, the land records will be updated with the right information.

To correct the land records, a rectification deed can also be submitted. This is done when the owner's name is misspelt on a freshly registered property.
